Agreement to Terms: By accessing or using Lead Piranha's website and services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
1. Introduction and Acceptance
Welcome to Lead Piranha! These Terms and Conditions ("Terms," "Agreement") govern your access to and use of the Lead Piranha website, platform, and services (collectively, the "Services").
By using our Services, you agree to:
- Be bound by these Terms and all applicable laws and regulations
- Our Privacy Policy and Cookie Policy, which are incorporated by reference
- Be at least 18 years of age or the age of majority in your jurisdiction
- Provide accurate, current, and complete information
Who We Are: Lead Piranha is a US-based lead generation and matching platform that connects buyers seeking services with qualified sellers. We operate as a marketplace facilitator and intermediary.
2. Services Description
2.1 Platform Services
Lead Piranha provides:
- For Buyers: A platform to request quotes, compare options, and connect with service providers in various categories (home services, professional services, etc.)
- For Sellers: Lead generation services, including matched buyer leads based on service offerings and geographic coverage
- Matching Algorithm: Automated matching technology to connect buyers with appropriate sellers
- Communication Tools: Facilitation of initial contact between parties
- Account Management: User dashboards for managing requests, leads, and preferences
2.2 Nature of Service
Important Disclaimer: Lead Piranha is a platform that connects buyers and sellers. We are NOT:
- A party to any transaction or contract between buyers and sellers
- Responsible for the quality, safety, legality, or accuracy of services provided by sellers
- An employer, agent, or representative of any buyer or seller
- A guarantor of any outcomes or results
All transactions and agreements are between buyers and sellers directly.
3. User Accounts and Registration
3.1 Account Creation
To access certain features, you must create an account:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breaches

3.3 Account Termination
You may terminate your account at any time by contacting support. We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- Your account remains inactive for an extended period
- Required by law or legal process
- You request deletion under data privacy rights (GDPR, CCPA, etc.)
4. User Conduct and Prohibited Activities
4.1 Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You will NOT:
- Violate any applicable laws, regulations, or third-party rights
- Post false, misleading, or fraudulent information
- Impersonate any person or entity
- Harass, abuse, threaten, or discriminate against others
- Spam or send unsolicited communications
- Attempt to gain unauthorized access to our systems
- Use automated tools (bots, scrapers) without permission
- Interfere with or disrupt the Services
- Reverse engineer or attempt to extract source code
- Collect user information without consent
4.2 Specific Prohibitions for Buyers
- Submitting fake or duplicate service requests
- Using the platform for purposes other than genuinely seeking services
- Circumventing the platform to avoid fees or obligations
- Sharing seller leads with competitors
4.3 Specific Prohibitions for Sellers
- Misrepresenting qualifications, licensing, or insurance
- Contacting buyers outside the platform before authorization
- Sharing or reselling leads to other parties
- Soliciting buyers to leave the platform
- Providing services without proper licensing or insurance
5. Payments and Fees
5.1 Buyer Fees
Our Services are generally free for buyers. However, we reserve the right to introduce fees for premium features with advance notice.
5.2 Seller Fees
Sellers pay for access to leads through:
- Subscription Plans: Monthly or annual subscriptions for lead access
- Pay-Per-Lead: One-time fees for individual leads
- Premium Features: Enhanced visibility, priority matching, analytics

5.3 Payment Processing
Payments are processed through third-party payment processors (Stripe, PayPal). By providing payment information, you:
- Authorize us to charge your payment method
- Represent that you have authority to use the payment method
- Agree to the payment processor's terms and conditions
- Understand we do not store full payment card details
5.4 Refund Policy
Subscription Refunds:
- Monthly subscriptions: No refunds; cancel anytime to prevent future charges
- Annual subscriptions: Prorated refunds available within 30 days of purchase
- After 30 days: No refunds, but you can cancel to prevent renewal
Lead Refunds:
- Invalid leads (wrong contact information, duplicate): Full refund within 7 days
- Unresponsive leads: No refunds (buyer responsiveness is not guaranteed)
- Leads outside service area: Full refund if properly documented
Refund Process: Submit refund requests to billing@leadpiranha.com with supporting documentation. Approved refunds processed within 10 business days.
5.5 Price Changes
We may change fees or pricing:
- With 30 days' advance notice for subscriptions
- Existing subscribers locked in at current rate until renewal
- Immediately for new subscriptions or pay-per-lead services
6. Intellectual Property Rights
6.1 Our Intellectual Property
All content, features, and functionality of the Services, including but not limited to:
- Text, graphics, logos, images, and software
- The Lead Piranha name, logo, and trademarks
- The platform design and user interface
- Matching algorithms and proprietary technology
- Compilation of user content and database structure
are owned by Lead Piranha or our licensors and protected by copyright, trademark, and other intellectual property laws.
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the Services for personal or business purposes
- View and download materials solely for use with our Services
You may NOT:
- Copy, modify, distribute, or create derivative works
- Use our trademarks without written permission
- Remove copyright or proprietary notices
- Use our intellectual property for commercial purposes outside the Services
6.3 User-Generated Content
You retain ownership of content you submit (reviews, messages, service descriptions). However, you grant us:
- A worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display your content
- The right to use your content for marketing and promotional purposes
- The right to sublicense to service providers who help operate our platform
You represent that:
- You own or have rights to all content you submit
- Your content does not violate any third-party rights
- Your content is accurate and not misleading

To the fullest extent permitted by law, Lead Piranha disclaims all warranties, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding accuracy, reliability, or availability of the Services
- Warranties that the Services will be uninterrupted, secure, or error-free
- Warranties regarding the quality, accuracy, or reliability of any information obtained through the Services
9.2 Seller Services Disclaimer
Lead Piranha does NOT warrant, endorse, guarantee, or assume responsibility for:
- The quality, safety, legality, or accuracy of services provided by sellers
- The qualifications, licensing, insurance, or credentials of sellers
- The performance, timeliness, or completion of work by sellers
- Pricing, quotes, or estimates provided by sellers
- Any disputes, claims, or damages arising from seller services
9.3 Buyer Disclaimer
Lead Piranha does NOT warrant:
- That buyers will receive responses from sellers
- The quality, accuracy, or timeliness of quotes received
- That matched sellers will be available or willing to provide services
- The seriousness or authenticity of buyer requests
9.4 Due Diligence
You are responsible for:
- Conducting your own due diligence on sellers (verify licenses, insurance, references)
- Reviewing and negotiating contracts directly with sellers
- Verifying all information provided by other users
- Taking appropriate precautions for your own safety and security
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
IN NO EVENT SHALL LEAD PIRANHA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
- DAMAGES RESULTING FROM:
- Your use or inability to use the Services
- Unauthorized access to your account or data
- Services or conduct of sellers or buyers
- Any content or interactions on the platform
- Third-party websites or services
OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED:
The greater of (a) $100 USD or (b) the amount you paid to Lead Piranha in the 12 months preceding the claim.
Jurisdictional Variations
EU/EEA/UK/Swiss Users: Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
Australian Users: Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, term, condition, right, or remedy implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified. Subject to this, our liability is limited to the extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Lead Piranha, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your content or information submitted to the Services
- Services provided or received through the platform
- Disputes with other users
- Your violation of any laws or regulations
We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense. You will cooperate with our defense of such claims.
12. Dispute Resolution and Arbitration
12.1 Informal Resolution
Before filing a claim, you agree to contact us at legal@leadpiranha.com to attempt to resolve the dispute informally. We'll work in good faith to resolve disputes within 60 days.
12.2 Binding Arbitration (US Users)
If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except as described below.
Arbitration Rules:
- Administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules
- One arbitrator selected per AAA rules
- Location: Your home state (or mutually agreed location)
- Decision is final and binding
- Each party pays own costs unless awarded by arbitrator
Exceptions to Arbitration:
- Small claims court matters (under jurisdictional limits)
- Intellectual property disputes
- Requests for injunctive relief for immediate harm
12.3 Class Action Waiver
You agree that disputes will be resolved on an individual basis only. You waive any right to:
- Participate in class actions or class-wide arbitration
- Act as a class representative or member
- Consolidate your dispute with other claims
12.4 EU/EEA/UK Users
EU/EEA/UK residents may bring legal proceedings in their country of residence or where we are established. Nothing in these Terms affects your rights under mandatory local consumer protection laws.

12.5 Australian Users
Australian residents may bring disputes in Australian courts. Nothing in these Terms affects your rights under the Australian Consumer Law or other mandatory Australian consumer protection laws.
13. Governing Law
13.1 US Users
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. The exclusive venue for any disputes shall be the state or federal courts located in Miami-Dade County, Florida.
13.2 International Users
EU/EEA/UK/Swiss Users: Your use of the Services is also governed by applicable EU data protection laws (GDPR) and consumer protection regulations in your country.
Australian Users: Your use of the Services is also governed by Australian consumer protection laws, including the Australian Consumer Law and Privacy Act 1988.
14. Modifications to Terms
We may modify these Terms at any time:
- We will post the revised Terms with a new "Effective Date"
- Material changes will be notified via email or prominent notice on our website at least 30 days before taking effect
- Continued use after changes take effect constitutes acceptance of the new Terms
- If you disagree with changes, you must stop using the Services and may close your account
Right to Object: EU/EEA users have the right to object to material changes and close their account within 30 days without penalty.
15. Termination and Suspension
15.1 Termination by You
You may terminate your account at any time by:
- Using account settings to close your account
- Contacting support@leadpiranha.com
- Following data deletion procedures in our Privacy Policy
15.2 Termination by Us
We may suspend or terminate your account or access to Services:
- Immediately for violations of these Terms
- For fraudulent, illegal, or harmful activity
- If required by law or legal process
- For extended inactivity (with advance notice)
- At our discretion with or without cause (with reasonable notice)
15.3 Effects of Termination
Upon termination:
- Your right to use the Services ceases immediately
- Paid subscriptions are non-refundable except as stated in Section 5
- Outstanding obligations remain in effect
- Sections of these Terms that by nature should survive (indemnification, liability, etc.) will survive
- You may request data deletion per our Privacy Policy
16. General Provisions
16.1 Entire Agreement
These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Lead Piranha regarding the Services.
16.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
16.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
16.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any successor or affiliate without restriction.
16.5 Force Majeure
We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, or government actions.
16.6 No Agency
Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Lead Piranha.
16.7 Notices
We may provide notices via:
- Email to your registered email address
- Posting on our website or within the Services
- Mail to your registered address

16.8 Language
These Terms are written in English. Any translations are provided for convenience only. In case of conflicts, the English version prevails.
